Background
The South Sudan Development Plan (SSDP) articulates the process and interventions required to realize Freedom, Equality, Justice, Peace and Prosperity for all. Underpinning this aspiration is the recognition that building an effective and capable State through strengthened capacity at all levels and private sector-led economic growth is necessary to contribute to poverty reduction. Furthermore, the SSDP recognises that the maintenance of peace and security are critical to ensure the requisite policy environment for durable poverty reduction, peace and development.

At County and Payam level, where justice, law and order services are often scarce, access to justice is often limited to customary law systems to settle disputes that sometimes fall outside the purview of such systems while in urban and peri-urban areas the formal justice system remains overwhelmed with a court case backlog and cases pending investigation due to a lack of sufficiently capacitated institutions and/or effective and efficient coordination mechanisms.

‘State building’, defined by the OECD as a process to enhance capacity, institutions and legitimacy of the state driven by state society relations, is fundamental to the reinstatement of the primacy of rule of law, as a foundation to sustainable development. Key aspects of “state building” processes include enhancing the capacity of the state to provide security and rule through law; containment, channeling and resolving conflict in society.

As such the proposed UNDP South Sudan Access to Justice and Rule of Law programme seeks a Programme Specialist to consolidate existing UNDP interventions that are delivered discretely to individual rule of law institutions, and community level interventions into a coherent and holistic programme designed to increase the availability, affordability, adaptability and acceptability of justice services in South Sudan. This programme approach is intended to achieve a positive balance between supply and demand side interventions to ensure that reforms are responsive to the evolving needs of communities served. This iterative process requires evidence based programming and thus adequate investment inter alia in crime statistics, court case management, recidivism rates and prison overcrowding to facilitate policy decision-makers to deploy resources efficiently and effectively.

The implementation of the Access to Justice and Rule of Law programme will also require collaborative and coordinated approach with other key players in the sector, and UNDP will collaborate, in particular, with the United Nations Mission in South Sudan (UNMISS).

Duties and Responsibilities
Under the direct supervision of the Governance and Rule of Law Unit Team Leader, the Access to Justice and Rule of Law Specialist will support the startup and implementation of the Access to Justice and Rule of Law programme in close collaboration with the Project Manager, Project team and project’s counterparts. The main functions of the Access to Justice and Rule of Law Specialist post are:

Lead in the process of startup, formulation/design and initiation of the Access to Justice and Rule of Law including the finalization of the programme document, AWP and budgets according to UNDP procedures;
Oversee the management and use of the programme financial resources
Ensure the timely submission of regular progress reports on project implementation as required (progress against planned activities, expenses against estimated budget, etc.), as well as the appropriate filing and availability of documentation required for internal and external evaluation purposes;
Lead in the creation and implementation of a system for regular monitoring and impact assessment of the project activities;
Lead in the formulation of case management and tracking capacity building activities for the judiciary, prosecutions, police and prisons including completion of capacity assessments and focused interventions that foster coordinated, efficient and effective delivery of justice services
Lead and support the development of crime statistics compilation and analysis capacity to facilitate the efficient deployment of justice sector resources;
Lead and support legislative reform including the adoption of a legal aid provision to increase access to justice services for the poor and marginalized.
Lead and facilitated the conduct end-user surveys on the responsiveness of justice services
Lead and facilitate research and codification of customary practices to ensure consistency, accountability and transparency;
Ensure the integration of gendered perspectives in programming activities
Prepare baseline analysis and issuance of background papers and documents regarding Access to Justice and Rule of Law in South Sudan and participate as required;
Facilitating dialogue and consultation around key milestones in the transitional period in South Sudan including constitutional reform and passage of key laws
Identify, liaise and work with all relevant local, national and international governmental and non-governmental actors forging synergies to maximize the project impact;
Facilitate the maintenance and development of relevant professional contacts and networks of cooperation with relevant practitioners, policy makers, academics and the international community working in South Sudan
Contribute to the UNDP democratic governance networks including dissemination of the best and innovative practices of the Access to Justice and Rule of project
Advise the Democratic Governance Unit and senior management on all matters pertaining to Access to Justice and Rule process in South Sudan and collaborates with other UNDP Offices and programmes as required;
Facilitate and participate in the formulation of joint work plan with UNMISS on areas of joint collaboration
Carries out other duties as assigned by the Team Leader or any person designated by him/her.

Impact of Results:
The key results have an impact on the overall institutional transformation of the country, the access to Justice and rule of law, consolidation of peace and security in Southern Sudan. The level of confidence in the democratic process by the general public, national and international partners increases with the consistent compliance, and fulfilment of constitutional obligations. The results of the work of the Access to Justice and Rule of Law Specialist greatly impact on the standing and reputation of UNDP, the Rule of Law Sector and at the RSS level. The outputs of the programme are:

Coordinated, efficient and effective delivery of justice services
Increased capacity of citizens to seek redress and access the formal and justice system at the community level
Enhanced capacity of the traditional justice system to be accountable in the delivery of justice services.

Required Skills and Experience
Education and Experience:·

An advanced degree (Masters or equivalent) in Law, International Relations, Political Science, Public Policy, Public
Administration, Social Sciences or a related field is required.
Minimum 5 years of working experience on issues related to development planning and/or institutional strengthening for the rule of law, justice and security sector
Relevant work experience in rule of law, justice and security development planning and capacity
Support in the context of post-conflict is required.
Proven and extensive track record in planning and policy support to public institutions; institutional capacity building and development programming
Work experience in a development context is essential - and previous experience in post-conflcit counties preferred.
Previous experience in working with high-level government counterparts and development partners.
Past experience with UNDP or other UN Agencies or International Non-Government Organizations in similar positions would constitute an advantage.
Experience working in peace-keeping contexts an advantage
Advanced computer skills and strong knowledge of various software including Excel, PowerPoint and Word

Language Requirements: Excellent knowledge of English and ability to communicate clearly in written and spoken English
